1. Services Overview
ElectricBidKit provides RFP curation, compliance matrix preparation, and draft response package services for electrical contractors bidding on government and utility projects. Our services are designed to support your bid preparation process, not replace your final review and submission responsibilities.
2. Scope of Work
Provider will:
- Review the RFP packet and addenda provided by Client
- Produce a Compliance Matrix identifying submission requirements, owners, and evidence needed
- Deliver the purchased package deliverables as described on the Pricing page
3. Out of Scope
The following are explicitly out of scope unless purchased separately in writing:
- Pricing, labor rates, margins, or cost estimates
- Final engineering design or technical calculations
- Legal review or legal advice
- Creation of new certifications or licenses
- Portal submission on Client's behalf
- Negotiation with the issuing agency
4. Client Responsibilities
Client agrees to:
- Provide complete and current RFP documents, including all addenda
- Provide accurate company credentials and past performance information
- Respond to clarification questions in a timely manner
- Review deliverables for accuracy before submission
- Provide all pricing, labor rates, and cost information
Delays in client inputs will pause delivery timelines.
5. Draft Nature of Deliverables
All deliverables are working drafts and organizational tools. Client remains responsible for verifying accuracy, approving all representations, ensuring compliance with RFP requirements, and submitting the final bid. We do not guarantee that deliverables are free from errors or omissions.
6. Revisions
Revision allowances are specified by package:
- Compliance Matrix: One (1) revision pass for factual corrections and addenda updates
- Draft Package Assembly: Two (2) revision passes for compliance and clarity corrections
Rewrites due to changed strategy, new content not previously provided, or major scope shifts are billed as additional work.
7. Acceptance
Deliverables are deemed accepted 3 business days after delivery unless Client reports material defects in writing. Material defects are limited to missed requirements that were clearly stated in the RFP documents provided by Client.
8. No Guarantee of Award
We do not guarantee contract award. Our services are designed to help you submit complete, organized bids, but the award decision rests solely with the issuing agency. Many factors outside our control affect award outcomes, including pricing, evaluation criteria, and competition.
9. Subscription Terms (WireBid Weekly)
WireBid Weekly subscriptions are billed monthly or annually as selected at checkout. Subscriptions auto-renew until cancelled. You may cancel at any time through your account or by contacting support.
30-Day Guarantee: If you don't find at least one bid worth reviewing in your first 30 days, we'll refund your subscription. Contact support to request a refund.
10. Rush and Addenda Fees
Rush fees apply when Client requests delivery faster than standard turnaround:
- 48-hour turnaround: +50% of package price
- 24-hour turnaround: +75% (Compliance Matrix only)
Rush clock starts when all required inputs are received.
Addenda updates are billed separately:
- Minor ($250): Admin changes, deadline changes, 1-2 page clarifications
- Standard ($450): Up to 10 pages changes, up to 2 new forms
- Major ($850): 10+ pages changes, scope changes, 3+ new forms
11. Confidentiality
We treat all RFP documents and company information as confidential. We will not share your information with third parties except as necessary to provide our services or as required by law. We can sign a mutual NDA upon request before you upload documents.
12. Limitation of Liability
To the maximum extent permitted by law, ElectricBidKit's total liability for any claim arising from our services shall not exceed the amount paid by Client for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost contracts.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
